www.bookmymariage.com runs an online platform (STARLIT WEDDINGS LLP) for the discovery, booking, and rental of marriage auditoriums and related services. By registering or using the Website or App, you acknowledge that you have read, comprehended, and are bound by this Agreement, as it may be modified from time to time. If you do not agree to any terms of service herein, you should immediately discontinue the use of the Website or App.

2. Eligibility and Description of Service

The Services of bookmymariage.com are only available to Users who are legally competent to enter into valid contracts under Section 11of Indian Contract Act 1872. www.bookmymariage.com is only an intermediary platform connecting user ‘’(Users)’’ with third-party vendors (“Vendors”) who list wedding auditoriums and allied services (wedding Cards, Photographers, Mehandi Artists, Balloon Decorations, Stage Decorations, Dancers, Party Hall) for rent. www.bookmymariage.com does not own, operate, or manage any such auditoriums. It does not warranty or guarantee the quality, availability, legality, or suitability of any facility or service offered by Vendors. All bookings, agreements, and transactions are between Users and Vendors directly, and www.bookmymariage.com is not a party to such agreements.

3. 3. Registration and User Account

To get the full features of the Website or App, including browsing, booking, and managing your rentals, you need to register by providing some personal information, like a valid mobile phone number and email address. This will be your unique identification on the platform. You ensure that any information provided while registering is correct, true, and complete. You may not post false or misleading information. Such action can result in the termination or suspension of your account. You particularly consent to receive messages from www.bookmymariage.com, including booking confirmations, service notifications, and promotional messages via SMS, calls, email, or messaging applications like WhatsApp. You recognize that you can opt out of promotional messages at any time, where available. bookmymariage.com can deny registration to any prospective user’’ (User)’’, or deactivate or suspend any account, at its sole discretion and without notice, particularly for violation of this Agreement or misuse of the service.

4. User Responsibilities and Conduct

Users will use the Website / App responsibly and in accordance with Information Technology Act,2000. You will not post, transmit, or distribute any content that is illegal, libelous, obscene, vulgar, abusive, threatening, invasive of privacy, hateful, racist, discriminatory, fraudulent, or otherwise objectionable as per Sections 66,67,67A,67B of Information Technology Act 2000 and offence punishable underSections124A, 153A, 153 B, 295A, 499, 500, 504, 505, 354A, 354D, and 509 of Indian Penal Code. Sections 151,196, 197, 299, 356, 352, 353, 331and Section79 of Bhartiya Nyaya Sanhita, 2023). Users will not infringe on any intellectual property rights of any third party or privacy or publicity rights of any individual under Sections 51 & 63 of Copy Right Act,1957, Sections 29 & 103 of Trade Marks Act,1999, Section 48 of Patents Act 1970, Sections 22 & 23 of Designs act, 2000, Sections 43A and72 of IT Act, 2000 and Article21 of the Indian Constitution. Use of the service for spamming, chain letters, junk mail, unauthorized advertising, or commercial solicitation is not allowed as per Sections 43,66,66D and 72 of IT Act 2000 and Sections 420,468 of IPC 1860(Sec 318 and 336 of BNS 2023) and Contract act Sec 73 and TRAI UCC Regulations,2018. Creation of fake accounts, impersonating others, attempting to access unauthorized accounts, injecting viruses or malicious code, or any other malicious activity will be a breach. You hereby take full responsibility for all actions under your account and for keeping your login information confidential.

5. Bookings, Payment, and Transactions

All bookings through www.bookmymariage.com are subject to the availability and terms of the Vendors. www.bookmymariage.com is merely a facilitator between Users and Vendors. The accuracy of Vendor listings, venue descriptions, pricing, availability, and terms is guaranteed by the Vendors, and www.bookmymariage.com does not make any representation or warranty as to their accuracy or completeness. All contracts for venue rental and services are solely between the User and the Vendor. Users agree that www.bookmymariage.com shall not be responsible for any disputes in Vendor services, damages, losses, or dissatisfaction, including cancellations, refunds, or payments (Payment and Settlement Systems Act, 2007, RBI Guidelines on Payment Aggregators/Payment Gateways (2020) IT (Intermediary Guidelines) Rules, 2021 – Rule 3(1)(b)(v). www.bookmymariage.com payments may be made using payment gateways from third parties; Users agree to adhere to the respective terms of use and disclosures.

6. Limitation of Liability

bookmymariage.com is a technological intermediary alone and disclaims all liabilities arising out of the usage of the Website or App. In no circumstance will www.bookmymariage.com or its affiliates, officers, employees, or agents be held liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or intangible losses, resulting from or related to the use or inability to use the services. This limitation will apply even if www.bookmymariage.com has been notified of the possibility of such damages. Users recognize that they are entirely responsible for their interactions with Vendors and use the site at their own risk.

7. Intellectual Property Rights

All intellectual property rights in the Website, including design, graphics, software, logos, trademarks, and content, are the exclusive property of www.bookmymariage.com or its licensors. Users are not allowed to copy, reproduce, distribute, or create derivative works from such materials without prior written permission. (Copyright Act, 1957 – Sections 14, 51, 55, 63, Trade Marks Act, 1999 – Sections 28, 29, 135 and Indian Contract Act, 1872 – Sections 73, 74). By posting any User-generated content such as reviews, photographs, or feedback, you grant www.bookmymariage.com a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, publish, and display such content in any format or medium (Copyright Act, 1957– Sections 2(c), 2(o), 17, 18, 19, 30, Indian Contract Act, 1872 – Sections 10, 73, 74 and IT Act, 2000 – Section 10(A). You warrant and ensure that you have all the rights and permissions for any content you post.

8. Privacy and Data Protection

By using bookmymariage.com, Users consent to the collection, processing, and transfer of personal data according to the bookmymariage.com Privacy Policy. This includes, but may not be limited to, name, contact details, usage patterns, and transactional information as necessary to provide the services, comply with legal obligations, and for marketing. Users have the right to access, change, or request deletion of their personal data under applicable legislation.

9. Grievance Officer

www.bookmymariage.com has also designated a Grievance Officer under the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, who would address user grievances and ensure that applicable laws are complied with. 10. Termination

www.bookmymariage.com reserves the right to suspend or end User accounts at any time without warning for any conduct that violates this Agreement or is determined to be harmful to the Website or App or its Users. Users can also terminate use of the Website or App at their own discretion by no longer accessing the site and providing written notice to www.bookmymariage.com if they desire to do so. Termination does not excuse Users from any unresolved commitments, disputes, or liabilities incurred prior to termination.

11. Third-Party Interactions

Users acknowledge that any transactions, payments, or communications with Vendors found through www.bookmymariage.com are exclusively between Users and Vendors. www.bookmymariage.com has no role and liability regarding the quality, safety, legality, or accuracy of services provided by Vendors, or for any problems arising from such interactions. The Website or App may contain links to other third-party websites, which are not governed by bookmymariage.com. bookmymariage.com disclaims all liability for the content or actions of such linked websites.

12. 12. Amendments to Terms and Service

www.bookmymariage.com may, at its sole discretion, at any time modify, update, or suspend all or part of the Website, App, or Terms and Conditions. Notice of significant changes will be provided on the Website or emailed to registered Users. Utilization of the Website or App after such change will constitute acceptance of the amended terms.

13. Governing Law and Jurisdiction

This Agreement and any dispute arising out of or in relation thereto shall be governed by and construed in accordance with the laws of India.  Proceedings shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, or Consumer Protection Act, 2019, or The Commercial Courts Act,2015, Magistrate Court, Payyanur, (Commercial Court, Payyanur) Consumer Court, Kannur. The arbitral proceedings shall be in English. Subject to the arbitration clause, the above courts alone shall have jurisdiction regarding all disputes arising out of or in relation to this Agreement.
